Boat Rental Agreement
This Boat Rental Agreement (“Agreement”) is entered into between 2Poochies Boat
Rentals, LLC (“Owner”) and the undersigned Renter. By signing this Agreement,
Renter acknowledges and agrees to all terms and conditions below.
1. Rental Period and Operating Hours
Boat operation is permitted only during designated daylight hours.
-The vessel must be returned and secured at the designated dock no later than one (1)
hour before dusk and must remain secured from dusk until sunrise.
-Operation outside permitted hours is strictly prohibited and may result in termination of
the rental without refund.
2. Vessel Inspection and Acceptance
Renter agrees to inspect the vessel and all equipment prior to departure.
-Any pre-existing damage or missing items must be reported to Owner before leaving the
dock, including photographic documentation when applicable.
-Failure to report issues constitutes full acceptance of the vessel and equipment in good
condition.
3. Condition, Use, and Cleaning
The vessel must be returned in the same condition as received, normal wear excepted.
-Renter authorizes Owner to charge for:
--Cleaning beyond normal use
--Repairs due to misuse or negligence
--Lost or damaged equipment
--Excessive wear
4. Fuel Policy
The vessel departs with a full tank and must be returned full.
-If not returned full, Renter authorizes Owner to:
Refill the tank
-Charge $5.00 per gallon, plus reasonable service time
5. Security Deposit Authorization (Card Hold)
Renter authorizes Owner to place a $1,500 pre-authorization hold on the Renter’s credit
card using Stripe or a similar secure processor.
-The hold will be placed prior to the rental period.
-The hold is not a charge and will be released after the rental, provided no issues
are identified.
-Authorization holds may expire in accordance with payment processor rules.
-Renter authorizes Owner to capture all or part of the authorized amount, and charge
additional amounts if necessary, for:
--Damage to vessel or equipment
--Missing items
--Cleaning beyond normal use
--Fuel shortages
--Towing or recovery
-Violations of this Agreement or the applicable boat checklist
6. Responsibility for Damage
Renter assumes full responsibility for all damage occurring during the rental period,
including but not limited to:
--Engine and propulsion components
--Hull and structural elements
--Seating and fixtures
--Electronics and accessories
-Renter acknowledges that lake environments may contain submerged hazards and agrees
that damage resulting from operation of the vessel is the Renter’s responsibility.
7. Equipment and Operation Disclaimer
Any onboard equipment, accessories, or navigation aids are provided for convenience
only and do not eliminate operational risk.
-Renter assumes full responsibility for safe operation of the vessel at all times.
8. Citations and Legal Compliance
Renter is solely responsible for any fines, citations, or penalties incurred during the rental
period.
9. Prohibited Activities
The following are strictly prohibited:
--Smoking on the vessel
--Cooking on the vessel
--Operation under the influence of drugs or alcohol
--Exceeding the maximum passenger capacity specified for the vessel
--Pets on the vessel unless explicitly permitted --Unsafe or reckless operation
--Any activity prohibited in the applicable boat checklist
-Violation may result in immediate termination without refund.
10. Operator Requirements
Renter must:
-Be 25 years of age or older
-Be legally permitted to operate a vessel in Alabama
-Possess required boating license or certification as follows:
(a) Alabama driver’s license with “V” vessel indicator, or
(b) Valid Alabama Boater Safety Certificate, or
(c) Equivalent NASBLA-approved certification from another state
-Be capable of safely operating the vessel
11. Safety Requirements
All required safety equipment must remain onboard and accessible.
Renter agrees to comply with all applicable safety requirements, including those defined
by law and in the boat checklist.
12. Cancellation Policy
Cancellations within 48 hours of reservation result in a $60 fee
-Weather-related cancellations may be rescheduled at Owner’s discretion
13. Boating Safety Acknowledgment (Required)
Renter acknowledges and agrees and confirms they have reviewed, understand, and agree to comply with the boating safety
requirements and operational rules:
1) Boat Checklist / Rules
2) Alabama Boating Laws and Requirements
3) U.S. Coast Guard Boating Safety Guidance
The applicable Boat Checklist / Rules are incorporated into this Agreement and form
part of the Renter’s contractual obligations.
14. Liability Waiver and Assumption of Risk
Renter acknowledges that boating involves inherent risks, including but not limited to:
--Collision
--Drowning
--Falling
--Changing weather conditions
--Submerged hazards
--Equipment malfunction
-Renter voluntarily assumes all risks and releases 2Poochies Boat Rentals, LLC,
including its owners, members, agents, and representatives, from any liability arising
from use of the vessel.
15. Agreement and Authorization
By signing below, Renter:
-Confirms they are 25 years of age or older
-Confirms they have read and understand this Agreement
-Agrees this is a legally binding contract
-Authorizes payment processing and damage charges as described
